ADCC 417/2025
This case involved an insurance dispute over compensation for severe injuries sustained by a minor in a traffic accident, where the claimant sought damages for physical injuries, permanent disability, and losses under a motor insurance policy.
Background
A Respondent filed an insurance dispute seeking AED 10,000,000 in compensation for injuries sustained by their minor son in a traffic accident involving a vehicle insured by the Appellant. The claim also included legal interest, urgent lawsuit fees, and a request for a medical expert review.
Proceedings
The Insurance Dispute Resolution Committee ruled that the Appellant must pay AED 300,000 in compensation, 5% interest, and additional costs.
Both parties appealed—the Respondent sought a higher compensation amount, while the Appellant contested the ruling.
The Appeal Court modified the compensation to AED 1,300,000 and upheld all other aspects of the ruling while rejecting the Appellant’s appeal. The Appellant then filed for cassation, and after preliminary review, the court deemed the appeal worthy of consideration, scheduling a hearing for further proceedings.
