ADCC 355/2025
The case concerned whether a lawsuit could proceed despite underpayment of judicial fees. The key legal issue was whether the failure to pay full mandatory fees for all claims rendered the proceedings void and required annulment due to violation of public order rules governing litigation in Abu Dhabi.
Background
The first Respondent institution filed Case No. 3086/2024 Commercial Simple Abu Dhabi against the Appellant institution, seeking a ruling requiring the Appellant to pay 142,000 dirhams, the value of five vehicles sold under a sales contract, along with 400,000 dirhams in compensation for material and moral damages.
The Respondent also requested, as a precautionary measure, the cancellation of the sales contract and the restoration of the original state before the agreement, including the issuance of clearance certificates for each vehicle. The Respondent sought an order requiring the Appellant to pay a rental fee of 2,500 dirhams per month for the vehicles from 20 June 2015 until full settlement.
