ADCC 340/2025
The case involved an insurance claim following a road traffic accident.. Fraud and overvaluation of the vehicle were issues and whether the insurer was required to pay the compensation. The use of evidence was also considered.
Background
A Respondent filed Insurance Dispute Complaint No. 3193/2024 with the Insurance Dispute Resolution Committee at the UAE Central Bank requesting an order requiring the Appellant company to pay AED 740,000 as compensation for the insured vehicle’s total loss and AED 10,500 for expert consultancy fees, along with the appointment of an expert. The Respondent claimed that on 24 July 2024, while driving the insured vehicle, an accident occurred, resulting in severe damage rendering the vehicle a total loss. The Respondent contacted the insurance company to claim the insured amount, but the company delayed payment, alleging the accident had been staged, which prompted the Respondent to file the complaint.
The Appellant requested an expert evaluation and argued compensation should not exceed AED 340,000.
