ADCC 264/2025

The dispute involved a claim for compensation arising from a fatal traffic accident, where the heirs of the deceased sought damages on top of blood money (diya). Other issues included what could be done at the appeal stage and how claims involving minors were to be handled.

Background

The heirs of a deceased person filed a claim against an insurance company seeking AED 5,950,000 for damages resulting from a fatal car accident caused by the insured driver. The driver was convicted in a criminal case and ordered to pay AED 400,000 in blood money (diya).

Proceedings

The Insurance Dispute Settlement and Resolution Committee awarded the heirs AED 400,000 for the deceased's death and separate amounts to each heir for their individual damages, plus 5% interest  calculated from the date of filing the claim. Both parties appealed. The court consolidated the appeals and decided to increase the compensation for the deceased's death to AED 1,500,000, in addition to changing the interest accrual date to the date of the court's judgment.

The insurance company then filed a cassation appeal.
