This case involved a request for an expert to review two companies accounts and return the companies. It was claimed the companies' licences had been leased to the other parties. However, it was not possible to lease a company licence so the contract was null. The case also considered the legal steps required to transfer ownership of a company.

Background

An Appellant in Appeal No. 986 of 2024 (a commercial case in Abu Dhabi) initiated Case No. 3568 of 2023 (a summary commercial case in Abu Dhabi).  This case sought the appointment of an accounting expert to examine the transactions and accounts of two companies —not parties to the appeal—to determine the Respondents' rights and obligations and to reveal any actions harming the Appellant's interests.  The Appellant aimed to hold the Respondents accountable for any such actions, thereby exonerating himself, terminating the parties' relationship, and compelling the return of the original licenses, seals, and related documents. Alternatively, the Appellant sought judgment based on the expert's findings, and, if the Respondents relinquished the licenses, AED 700,000 in compensation.
