Background
An Appellant filed objection No. 63/2024, requesting the cancellation of all execution procedures issued against him in Execution No. 133/2017 and to permanently remove their name from the execution file due to their lack of standing and as an accessory claim, an accounting expert to appoint an accounting expert to review the accounts of the company, the judgment debtor, and to determine its financial status and whether the Appellant had committed a negative or positive act that prevented the company from paying the amount awarded or not.
This claim was based on the fact that the company and the Appellant was not a party to the execution writ, as the Court of Appeal had ruled in Appeal No. 657/2016 to cancel the judgment obliging them jointly with the company in question and to dismiss the case against them. Therefore, the execution procedures against them in the execution file lacked legal basis.
