ADCC 77/2024
The case involved a healthcare consultant claiming unpaid wages under a revenue-sharing agreement. The key issue was whether the employer could defer payment based on pending insurance reimbursements, and whether such a clause was valid under UAE labour law.
Background
A Claimant sued a Defendant, seeking to cancel their contract dated 9 February 2021 and demanding 503,298 dirhams in unpaid dues plus 50,000 dirhams in damages, due to the Defendant not paying their share of revenues as agreed. The Claimant worked at the Defendant's centre and was entitled to receive 50% of consultation and examination fees. The Court of First Instance ruled the case inadmissible, and the Claimant appealed.
