The initial dispute involved property in an estate which had been rented out but had not been returned when the contract ended. Rent had not been paid. The key issue was the status of the case as it had been filed by a judicial guardian who was dismissed from that role during the proceedings.

Background

An Appellant in a first appeal, in the capacity of the judicial guardian of an estate, filed Case No. 626/2023 (Commercial) in the Abu Dhabi Court of First Instance against the Respondents. The Appellant requested they be jointly and severally obliged to pay 5 million dirhams, representing the rental value for the period 2021/2022, with legal interest of 9% annually from the date of notice until full payment. Additional claims included overdue rent from 01/08/2022 until the actual delivery date of the building, 10 million dirhams for complete maintenance, and 2 million dirhams as compensation for moral and emotional damages, along with fees and attorney's fees.
