This case involved payment orders against an individual who claimed he was not the real owner of a sole trader and was only registered on the license for temporary legal reasons. It was claimed another party had admitted he was a guarantor in a settlement agreement. It was also claimed the judges lacked capacity to rule on an appeal.
Background
An Appellant filed Case No. 595 of 2023, requesting a ruling to oblige the Respondents, jointly and severally, to amend the registration of a license of a sole proprietorship (not a party to the appeal) from the Appellant's name to the name of either of them or any person they chose, and to pay him 68,956 dirhams paid by him without justification in executions attached to him and the establishment, and t50,000 dirhams as compensation.
