ADCC 708 and 716/2023

This case involved amounts due to a contractor who had only partially completed construction work when the contract was terminated. Issues included the court's interpretation of the expert report and VAT invoice requirements.

Background

A Respondent in the first appeal filed against the Appellant in the same appeal Case No. 410/2023, requesting to compel him to pay 725,982.93 AED and late interest at the rate of 9% annually from the date of filing the case until full payment. 

It also requested that the Appellant pay compensation for the lost profits that they suffered as a result of his unilateral termination of the contract, equivalent to 10% of the total remaining work in the project, estimated at 50,000 AED, and deferred interest from the date of the final ruling at the rate of 9% until full payment. 

On 31/07/2018, they had concluded with the Appellant, in the presence of the project consultant, a contracting contract for the completion of a new residential villa with services, an electrical room, and an external fence.
