ADCC 649/2023

This case involved entitlement to a cheque which had bounced. Issues included whether the court had jurisdiction because the cheque was issued as a deposit for rental of a property and the tenant had not been given access to the property. Also considered was whether this case could be appealed.

Background

An Appellant filed suit No. 525 of 2023 against the Respondent requesting to prove that the Respondent was not entitled to cheque amounts, due to the absence of any of the two cases stipulated exclusively in Article 667 of Federal Decree-Law No. 50/2022 , and the lack of jurisdiction of the enforcement judge to consider the dispute since it was a substantive dispute in which jurisdiction rested with the committee for Resolving rental disputes.
