ADCC 191/2009

This case involved a claim for compensation in a medical negligence case, where the patient had suffered disability following surgery. The medical report was queried as the results of this report had been rejected. Key points were that the report was comprehensive and a second doctor had evaluated it.

Background

A claimant filed a case against the defendants claiming that he had been through surgery in a hospital owned by one of the defendants and the doctors had made a mistake which resulted in injury. The claimant requested the court to order the defendants to pay him compensation.

The expert appointed by the court stated in his report that the mistake had resulted in the claimant's 100% impotence. The court ruled the defendants should pay the claimant 600000 AED and 50000 AED in compensation. The court rejected the case against one of the defendants.

The defendants appealed the ruling before the court of appeal. The court upheld the ruling.
