ADCC 1013/2009

The original dispute involved an unpaid construction contract between a deceased and the claimant. The appeal was rejected as the court documents proved that the parties had previously agreed a settlement and had admitted they had received the building in a good state and without shortcomings.

Background

A claimant filed a case against the defendants and requested the court to appoint an expert to review works they had completed, assess its value and compensation that the defendants should pay for delaying payment. The claimant stated they had agreed with a deceased man (the defendant's father) to build a building and that the defendants (the heirs) had refused to pay the remaining amounts.

The defendants requested the court to add the second defendant to the case and appoint an expert to assess the building and the unfinished work. The defendants also requested the court add a third defendant to the case and get a permission letter to change the contractor.

After appointing an expert, the court ruled the heirs should pay the claimant 1497177 AEDs and rejected other requests.
