Cassations – Judgments – Value – Appellant – Request – Conditional – Passport – Trial court – Departure from work – Reasonable grounds – Filing an action – Professional mistakes – Prior notice – End of service
Cassations on the judgments of value less than AED 200,000 shall not be considered, unless the value is not estimated. Action with request of less than AED 200,000 filed by the appellant including a request of not estimated value conditional to delivery of passport is considered. The trial court has the authority to assess the employee departure from work, whether voluntarily or involuntarily, in application to one of the two cases stated in article 121 of Labor Law so long as it is based on reasonable grounds. Filing an action by the respondent institution against the appellant employee working with it in order to hold him accountable for losses incurred as a result of his professional mistakes and the travel order issued by the court against him are considered an assault on the appellant which allows him to leave work without prior notice or prohibition from end of service gratuity.
