ADCC 172/2008

This case involved a claim for damages against an insurance company, including a claim for the loss of an eye following a road traffic accident. Half blood money was requested along with other damages. This was the correct compensation for the loss of one eye. The court should have explained the components of the damage.

Background

A claimant filed a case on behalf of herself and her son against an insurance company and requested the court to pay 1253800 AED. The claimant stated her son had been injured in a car accident.

The court ruled that the insurance company should pay the claimant 48000 AED in compensation for the damage to the car and 30000 AED in compensation for son's injuries.

The claimant and the company appealed the ruling before the court of appeal. The court rejected the company's appeal. The court accepted the claimant's appeal ruled that the company should pay the claimant 100000 AED or half of the blood money because the son had lost his left eye and there should be 100000 AED in compensation for nominal and material damage, plus another 48000 AED awarded.
