The original dispute involved a claim for unpaid credit facilities. A key point was the way interest should be calculated. The case also looked at the remit of the court of first instance and appeal court in a circumstance where inappropriate procedures had occurred at the appeal stage. The appeal court did not have the right to overturn the court of first instance ruling simply because there had been incorrect procedures at appeal stage if the claim was valid to start with.
